“A governing body knows everything that goes into its legislative decisions whether it actually knows it or not.”

I stumbled off the track to success in 1968, started chasing shadows that summer. Since then, In addition to farm-laborer and newspaper photographer my occupational incarnations include dishwasher, janitor, retail photo clerk, plumber, HVAC repairman, auto mechanic, CAT scan technologist, computer worker and politico (whatever it takes to buy a camera.) I am on the road to understanding black and white photography.

  1. It’s just the same as the fine print in a contract you signed. You’re presumed to know legally whether you read it or not since the presentation of the contract and your signature represent your having received “constructive notice”. And we all know the mantra about ignorance of the law being no excuse for criminal subjects, no matter how bizarre and abstruse the law may be and the defendant being a foreigner with no cultural background relating to the law: viz, the legality of eating dogs as one example.
Works the same way with liability suits where it is said the defendant “knew or should have known”. We all know of course that it works this way in govt. When Congress votes on a bill it’s usually coming out of a committee most of whose members haven’t read every word, or even more than a fraction, and the actual body of Congress that rubber stamps the bill likely is even more clueless about its contents. So I guess it makes sense as much as anything relating to institutions does.

  2. Speaking from the bowels of an institution, I can certify that one organ knoweth not what another doeth, let alone what the whole doeth. But that never stopped anybody from acting *as though* they did know. Until maybe it turned out they didn’t…
